La European Resort Owners Coalition (EUROC) ha pubblicato una nota informativa per aiutare i proprietari di multipropriet\u00e0 a comprendere le implicazioni di questo sviluppo giuridico.<\/p><p>La sentenza della Corte Suprema riguarda lo status giuridico dei sistemi di multipropriet\u00e0 esistenti prima della legislazione del 1998. In precedenza, vi era incertezza sul fatto che i contratti di durata superiore a 50 anni o quelli che comportavano interessi fluttuanti (come le settimane fluttuanti) fossero automaticamente nulli.<\/p><p>La Corte ha chiarito che i contratti per i piani esistenti prima della Legge 42\/98 non sono automaticamente annullati sulla base della sola durata o dell'inclusione di interessi fluttuanti. Chiarendo lo status dei contratti pi\u00f9 vecchi, la sentenza mira a ridurre le controversie e la confusione sulla validit\u00e0 dei contratti. Il tribunale ha sottolineato la necessit\u00e0 di proteggere i diritti acquisiti, garantendo al contempo la trasparenza dei termini contrattuali.<\/p><p><strong>EUROC consiglia cautela e verifica<\/strong><\/p><p>Sebbene la sentenza fornisca chiarezza giuridica, EUROC consiglia ai proprietari di multipropriet\u00e0 di affrontare il nuovo panorama con diligenza. L'organizzazione raccomanda ai proprietari di interessi in multipropriet\u00e0 in schemi precedenti al 42\/98 di verificare con il proprio sviluppatore o operatore di resort che lo schema sia stato formalmente adattato e registrato presso il Catasto.<\/p><p>EUROC incoraggia i proprietari a consultare direttamente i propri operatori di multipropriet\u00e0 in merito all'impatto di questa dottrina sui loro accordi specifici.
