Le 30 octobre 2025, la Cour supr\u00eame espagnole a rendu un arr\u00eat concernant la validit\u00e9 des contrats de multipropri\u00e9t\u00e9, en particulier ceux \u00e9tablis avant la promulgation de la loi espagnole 42\/98. L'European Resort Owners Coalition (EUROC) a publi\u00e9 une note d'information pour aider les propri\u00e9taires de biens \u00e0 temps partag\u00e9 \u00e0 comprendre les implications de cette \u00e9volution juridique.<\/p>

L'arr\u00eat de la Cour supr\u00eame porte sur le statut juridique des contrats de multipropri\u00e9t\u00e9 en temps partag\u00e9 qui existaient avant la l\u00e9gislation de 1998. Auparavant, il n'\u00e9tait pas certain que les contrats d'une dur\u00e9e sup\u00e9rieure \u00e0 50 ans ou ceux impliquant des int\u00e9r\u00eats flottants (tels que les semaines flottantes) soient automatiquement nuls et non avenus.<\/p>

La Cour a pr\u00e9cis\u00e9 que les contrats relatifs \u00e0 des projets ant\u00e9rieurs \u00e0 la loi 42\/98 ne sont pas automatiquement annul\u00e9s sur la seule base de la dur\u00e9e ou de l'inclusion d'int\u00e9r\u00eats flottants. Cette d\u00e9cision judiciaire \u00e9tablit un cadre juridique destin\u00e9 \u00e0 assurer la stabilit\u00e9 du secteur et des consommateurs. En clarifiant le statut des anciens contrats, la d\u00e9cision vise \u00e0 r\u00e9duire les litiges et la confusion concernant la validit\u00e9 des contrats. La Cour a soulign\u00e9 la n\u00e9cessit\u00e9 de prot\u00e9ger les droits acquis tout en garantissant la transparence des clauses contractuelles.<\/p>

EUROC recommande la prudence et la v\u00e9rification<\/strong><\/p>

Bien que la d\u00e9cision apporte une clart\u00e9 juridique, l'EUROC conseille aux propri\u00e9taires de biens \u00e0 temps partag\u00e9 d'aborder le nouveau paysage avec diligence. L'organisation recommande aux propri\u00e9taires d'int\u00e9r\u00eats en temps partag\u00e9 dans des syst\u00e8mes ant\u00e9rieurs \u00e0 42\/98 de v\u00e9rifier aupr\u00e8s de leur promoteur ou de l'exploitant du centre de vill\u00e9giature que le syst\u00e8me a \u00e9t\u00e9 formellement adapt\u00e9 et enregistr\u00e9 au registre foncier.<\/p>

L'EUROC encourage les propri\u00e9taires \u00e0 consulter directement leurs op\u00e9rateurs de multipropri\u00e9t\u00e9 pour savoir comment cette doctrine affecte leurs accords sp\u00e9cifiques. L'organisation met en garde contre l'engagement avec des op\u00e9rateurs tiers non sollicit\u00e9s qui peuvent contacter les propri\u00e9taires sans autorisation pr\u00e9alable.<\/p>

\"Les consommateurs doivent toujours contacter l'exploitant de leur centre de vacances \u00e0 temps partag\u00e9 en premier lieu pour v\u00e9rifier toute information ou avant d'accepter l'assistance d'une partie ext\u00e9rieure\".<\/em> EUROC a d\u00e9clar\u00e9 dans son communiqu\u00e9.\u00a0<\/p>
