La European Resort Owners Coalition (EUROC) ha publicado una nota consultiva para ayudar a los propietarios de tiempo compartido a comprender las implicaciones de esta novedad jur\u00eddica.<\/p><p>La sentencia del Tribunal Supremo aborda la situaci\u00f3n jur\u00eddica de los reg\u00edmenes de aprovechamiento por turno que exist\u00edan antes de la legislaci\u00f3n de 1998. Anteriormente, exist\u00eda incertidumbre sobre si los contratos de m\u00e1s de 50 a\u00f1os o los que implicaban intereses flotantes (como las semanas flotantes) eran nulos de pleno derecho.<\/p><p>El Tribunal ha aclarado que los contratos relativos a reg\u00edmenes existentes con anterioridad a la Ley 42\/98 no se anulan autom\u00e1ticamente bas\u00e1ndose \u00fanicamente en la duraci\u00f3n o en la inclusi\u00f3n de intereses flotantes. Al aclarar la situaci\u00f3n de los contratos m\u00e1s antiguos, la sentencia pretende reducir los litigios y la confusi\u00f3n sobre la validez de los contratos. El tribunal subraya la necesidad de proteger los derechos adquiridos al tiempo que se garantiza la transparencia de las cl\u00e1usulas contractuales.<\/p><p><strong>EUROC aconseja precauci\u00f3n y verificaci\u00f3n<\/strong><\/p><p>Aunque la sentencia aporta claridad jur\u00eddica, EUROC aconseja a los propietarios de tiempo compartido que aborden el nuevo panorama con diligencia. La organizaci\u00f3n recomienda que los titulares de derechos de aprovechamiento por turno en reg\u00edmenes anteriores a 42\/98 comprueben con su promotor u operador tur\u00edstico que el r\u00e9gimen se ha adaptado formalmente y se ha inscrito en el Registro de la Propiedad.<\/p><p>EUROC anima a los propietarios a consultar directamente con sus operadores de tiempo compartido c\u00f3mo afecta esta doctrina a sus acuerdos espec\u00edficos.
